Agreement to Legal Terms

1. User Eligibility and Age Verification
Access to the Platform and use of the Services is strictly limited to individuals who:
- Are natural persons aged 18 years or older;
- Are physically located within the territory of Australia; and
- Are not subject to any legal restriction or exclusion under applicable laws or platform rules that would prohibit their access or participation.

Aussie Lucky Numbers is a licensed digital platform that facilitates the purchase of official lottery tickets from overseas lotteries on behalf of eligible Australian residents. Our role is strictly limited to that of a lottery courier service, not a lottery operator or wagering provider.
Each transaction through the Platform corresponds to the lawful acquisition of a genuine lottery ticket from an authorised foreign lottery retailer. The ticket is procured, held, and managed in trust on your behalf. Digital proof of purchase is issued following successful processing.
The Platform enables participation in lotteries including, but not limited to, US Powerball, Mega Millions, EuroMillions, SuperEnalotto, La Primitiva, UK National Lottery, and others. We are not affiliated with, endorsed by, or a licensee of any such international lottery operator.
All operations are conducted under Australian jurisdiction and local licensing, with full ticket handling, user support, and compliance functions managed within Australia.
3. Legal Nature of Lottery Courier Model
Our business model is based on the legal courier acquisition and custodial management of lottery tickets. We do not operate or conduct any lottery draw. Tickets are sourced from third-party licensed providers in the jurisdiction of the relevant lottery.
By using the Platform, you:
- Acknowledge that you are not wagering on outcomes or entering a lottery conducted by us;
- Understand and agree that each purchase results in the acquisition of a real ticket, in your name or on your behalf, held under trust;

You acknowledge that lottery participation involves financial risk and may not result in any return. You are solely responsible for decisions made through your account and for ensuring your use is lawful under your circumstances.
6. Prohibited Uses and Platform Misuse
You must not, under any circumstances:
- Create, maintain, or operate more than one account per person;
- Provide false, misleading, or fraudulent identity, residency, or payment information;
- Use the Platform while located outside Australia;
- Bypass or attempt to circumvent geo-blocking, age verification, or identity controls;
- Employ bots, scripts, automation tools, or unauthorised software to interact with the Platform;
- Interfere with or disrupt Platform functionality, data integrity, security mechanisms, or infrastructure;
- Upload or disseminate viruses, worms, spyware, or malicious code;
- Promote, facilitate, or engage in illegal gambling, pyramid schemes, money laundering, or fraud;
- Solicit or target minors or vulnerable individuals in connection with gambling;
- Breach Australian advertising standards or gambling promotion laws.
Violation of this section may result in immediate termination of your account, forfeiture of entries or balances, and referral to law enforcement or regulatory bodies.
7. Intellectual Property and Licensing
All intellectual property in the Platform, including but not limited to text, graphics, layout, code, software, trademarks, service marks, and logos ("Content"), is owned by or licensed to GAINEROO PTY LTD and protected under applicable Australian and international intellectual property laws.
We grant you a revocable, non-exclusive, non-transferable licence to use the Platform solely for lawful personal participation in the Services.
You must not:
- Copy, reproduce, publish, distribute, or exploit the Content for commercial purposes;
- Decompile, disassemble, or reverse-engineer any part of the Platform;
- Use our branding or marks without prior written consent.
Any unauthorised use may constitute a breach of intellectual property rights and result in legal action.
Third-party trademarks, logos, or branding displayed on the Platform remain the property of their respective owners. No rights are granted to you in relation to such material.
8. User Communications and Feedback

By submitting User Communications, you represent and warrant that:

12. Termination, Suspension and Account Closure

- You engage in activity deemed unlawful, harmful, or inconsistent with Platform integrity;

Termination of your account includes:
- Immediate revocation of Platform access;
- Closure of your user wallet and cancellation of unfulfilled orders where legally required;
- Retention or deletion of your data as required under Australian law and our Privacy Policy.
Termination does not affect accrued rights or obligations. We are not liable for any losses or inconvenience arising from suspension or termination of access.
13. Liability Disclaimers
To the fullest extent permitted by law:
- The Platform and Services are provided on an "as is" and "as available" basis without any warranty or guarantee of continuous availability, reliability, or performance;
- We expressly disclaim all express or implied warranties, including those of merchantability, fitness for a particular purpose, non-infringement, or error-free operation;
- We do not guarantee successful ticket purchase, transmission, or draw entry for any lottery ticket or draw;
- We do not guarantee winnings, entry confirmations, or the accuracy or real-time delivery of draw results;
- We are not responsible for interruptions, errors, or unavailability caused by third-party lottery providers, financial institutions, or network infrastructure.
You acknowledge that participation in lotteries involves financial risk and agree that you do so voluntarily and at your own discretion.
This clause does not exclude any guarantees, conditions, warranties, or rights that cannot be excluded under the Competition and Consumer Act 2010 (Cth).
14. Limitations of Liability
Subject to applicable law, including non-excludable rights under the Australian Consumer Law, we limit our liability as follows:
- We are not liable for any indirect, incidental, special, exemplary, or consequential loss or damage arising out of your use or inability to use the Platform, including but not limited to loss of data, profits, business interruption, or reputational harm;

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded under law.
15. Indemnity and Reimbursement
You agree to fully indemnify and hold harmless GAINEROO PTY LTD, its officers, employees, agents, affiliates, licensors, and contractors from and against all claims, losses, liabilities, damages, expenses, penalties, and legal costs (on a full indemnity basis) arising directly or indirectly out of:
- Your breach of these Terms or any applicable law or regulation;
- Any content or data submitted by you that infringes third-party rights or is defamatory or unlawful;
- Any fraudulent, negligent, or unauthorised use of your account;
- Any use of the Platform or Services that violates these Terms, licensing conditions, or platform policies.
We reserve the right to assume exclusive control over the defence of any matter subject to indemnity. You agree to cooperate fully with such defence.
16. Data Collection, Privacy and Consent

By using the Platform, you consent to our collection, use, and disclosure of personal information for lawful purposes as set out below:

Electronic communications are deemed received upon transmission, not when opened or acknowledged.
18. Consumer Law and Non-Excludable Guarantees
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law (ACL), including guarantees relating to:
- Goods and services being of acceptable quality and fit for their disclosed purpose;
- Services being provided with due care and skill;
- Goods matching their description or sample.
Where a statutory right or guarantee applies and cannot be excluded, and where permitted by law, our liability is limited, at our discretion, to:
- The re-supply of the relevant Services; or
- The payment of the cost of having the Services supplied again.
This section prevails over any other provision to the extent of any inconsistency with the ACL.
19. Governing Law and Jurisdiction
These Terms are governed by the laws of:

- The Commonwealth of Australia, including but not limited to the Interactive Gambling Act 2001 (Cth), Privacy Act 1988 (Cth), and the Competition and Consumer Act 2010 (Cth).
You irrevocably submit to the exclusive jurisdiction of the courts of the Northern Territory and applicable federal courts of Australia for the resolution of any dispute arising under or in connection with these Terms, the Platform, or the Services.
If you access the Platform from outside Australia, you do so at your own initiative and are solely responsible for compliance with applicable local laws.
